Terms of Service

1. Acceptance of Terms

By accessing or using Etalka ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Etalka provides a peer-to-peer communication platform that allows users to make direct voice and video calls and exchange messages between supported web browsers. Calls and messages are transmitted directly between users' devices whenever possible and are not routed through or stored by Etalka's infrastructure.

3. Eligibility and Accounts

You must be at least 13 years old to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate any account at our sole discretion, with or without notice.

4. Acceptable Use

You agree not to use Etalka to:

• Harass, abuse, threaten, or defame any person.
• Transmit unlawful, harmful, obscene, or infringing content.
• Interfere with or disrupt the App or its underlying networks.
• Reverse engineer, decompile, or attempt to extract source code.
• Use automated scripts, bots, or scrapers.
• Impersonate any person or misrepresent your identity.

5. Peer-to-Peer Communications

Etalka uses WebRTC and other browser technologies to establish direct connections between users. Because communications are peer-to-peer, we do not have the ability to monitor, moderate, record, or retrieve the content of your calls or messages. You acknowledge that you are solely responsible for the content you share and the people you communicate with.

6. No Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, secure, or compatible with every device or network. Peer-to-peer connectivity depends on your network, browser, and device capabilities.

7. Limitation of Liability

To the maximum extent permitted by law, Etalka and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the App, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Etalka and its operators from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.

9. Modifications to the Service and Terms

We may modify, suspend, or discontinue the App (or any part of it) at any time without notice. We may also update these Terms from time to time. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California.
